Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and FeatBudy ("FeatBudy", "we", "us", or "our") governing your access to and use of the FeatBudy website at featbudy.com and the feedback boards, roadmaps, changelogs, mini-surveys, widgets, embeds and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy at featbudy.com/privacy-policy. If you do not agree, do not use the Service.
1. Definitions
- "Account" means your FeatBudy login.
- "Customer" or "you" means the person or organisation that opens an account and operates one or more workspaces.
- "Workspace" means a feedback space you create, including its board, roadmap, changelog and surveys.
- "End User" means a visitor who interacts with a Workspace by submitting requests, votes, comments or survey answers.
- "Content" means any text, votes, images or other material submitted to the Service by you or your End Users.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You agree to provide accurate, current information and to keep it up to date.
- We use passwordless sign-in (magic links) and Supabase authentication. You are responsible for keeping access to your email and Account secure and for all activity under your Account.
- Notify us immediately at hello@featbudy.com of any unauthorised use of your Account.
3. The Service and plans
FeatBudy offers Starter, Pro and Scale plans with different limits and features, as described on our pricing page. Some features (for example, removing the FeatBudy badge, additional mini-surveys, the Slack integration, or a custom domain) are available only on certain plans, and we enforce these limits.
We may add, modify or discontinue features at any time as part of the ongoing development of the Service. Where practical, we will provide reasonable notice before removing material functionality from paid plans.
Any free plan or free tier is offered at our discretion, and we may change, suspend or discontinue it at any time.
4. Service availability, support and beta features
- We may temporarily suspend or restrict the Service for maintenance, upgrades, migrations or security reasons. We will use reasonable efforts to minimise disruption but do not guarantee that the Service will be available without interruption.
- Unless expressly agreed with you in writing, we do not provide any service level agreement (SLA) or uptime commitment.
- We provide support on a reasonable-efforts basis and do not guarantee any response or resolution times unless separately agreed in writing.
- We may offer beta, preview or experimental features. These are provided for evaluation only, on an "as is" basis, and may be modified or discontinued at any time without liability.
5. Subscriptions, billing and payment
- Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment processor, Stripe. Yearly plans are billed once for the year.
- By subscribing, you authorise us and Stripe to charge your payment method for the applicable fees and taxes until you cancel.
- Subscriptions renew automatically at the end of each billing cycle at the then-current price unless you cancel before renewal.
- Prices are shown in the currency displayed at checkout (for example USD or EUR) and may exclude taxes, which are added where required.
- We may change our fees. We will give you reasonable prior notice, and changes take effect at your next billing cycle. Continued use after a price change means you accept it.
- If a payment fails, we may retry it and may downgrade or suspend paid features until payment succeeds.
6. Free trials and fair use of pricing
We may offer free trials at our discretion. Unless you cancel before the trial ends, your paid subscription begins automatically and we charge the applicable fee. We may modify or withdraw a trial offer at any time.
We may refuse, suspend or terminate Accounts that appear to be created to circumvent pricing, plan limits, trial restrictions or usage limits (for example, by opening multiple Accounts).
7. Cancellation and refunds
- You can cancel at any time from your billing settings or the Stripe customer portal. Cancellation stops future renewals; you keep access to paid features until the end of the current billing period.
- Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial periods. We may consider refund requests on a case-by-case basis at our discretion.
- If you are a consumer in the EU or EEA, statutory withdrawal rights may apply. By starting a subscription you may ask us to begin providing the Service immediately, which can affect those rights.
8. Your Content, backups and licence
- As between you and FeatBudy, you and your End Users own your Content. We do not claim ownership of it.
- You grant FeatBudy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and process Content solely to operate and provide the Service, including displaying it on your public board, roadmap, changelog, widgets and embeds.
- You are responsible for your Content and your Workspaces, including having the rights and legal basis needed to collect and publish End-User data, and for moderating your board.
- You are responsible for keeping your own copies of any Content that matters to you. While we take reasonable measures to protect data, we do not guarantee that Content can always be recovered, and you should not rely on the Service as your only record.
- Where you use the Service to collect personal data from your End Users, you act as the data controller and FeatBudy acts as your processor. Our Data Processing Agreement is available on request and forms part of these Terms when applicable. See our Privacy Policy at featbudy.com/privacy-policy.
9. Acceptable use
You agree not to, and not to allow anyone to:
- use the Service for anything unlawful, infringing, defamatory, harassing, hateful, or that violates others' rights;
- post spam or malware, or attempt phishing;
- upload sexually explicit, violent, or otherwise inappropriate content;
- interfere with, disrupt or overload the Service, or attempt to gain unauthorised access to it or its systems;
- overload, degrade or threaten the stability, security or integrity of the Service, or exceed the reasonable usage levels of your plan, including any documented or reasonable limits on API, webhook, storage or email usage;
- reverse engineer, scrape, or resell the Service except to the extent permitted by law;
- falsely imply any partnership, endorsement, sponsorship or affiliation with FeatBudy;
- use the Service's messaging, notification or email features in breach of applicable laws, including anti-spam and consent requirements — you remain responsible for all communications sent through your Workspaces to your End Users;
- remove or circumvent the "Powered by FeatBudy" badge except on plans that include its removal.
We may set and enforce reasonable limits on API, webhook, storage, email and other usage. We may limit, throttle or suspend usage that exceeds those limits, that is excessive or abusive, or that negatively affects the stability or security of the Service or other customers.
10. Public boards and End Users
You control your Workspaces and are responsible for your relationship with your End Users, for any moderation, and for compliance with applicable laws (including privacy and consumer-protection laws) on your board. FeatBudy is not responsible for Content submitted by you or your End Users.
11. Intellectual property
The Service, including its software, design, branding and content (but excluding Customer and End-User Content), is owned by FeatBudy and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not use our name, logos or trademarks without our written permission.
If you send us feedback or suggestions about the Service, you grant us the right to use them without restriction or compensation.
12. Third-party Services and Integrations
The Service integrates with third-party services (such as Stripe, Slack, Supabase, Resend and Vercel). Your use of those services is governed by their own terms and policies, and we are not responsible for them.
13. Suspension and termination
- You may stop using the Service and close your Account at any time.
- We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others, to the Service or to us — with notice where reasonable.
- On termination, your right to use the Service ends and we will generally delete Customer data within 30 days after your Account is closed, unless we are required to retain it longer to comply with legal, tax or accounting obligations, as described in the Privacy Policy. Provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability and indemnification) will survive.
14. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
15. Limitation of liability
To the maximum extent permitted by law, FeatBudy will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to defend, indemnify and hold harmless FeatBudy from any claims, damages and expenses arising out of your Content, your use of the Service, your Workspaces and End Users, or your breach of these Terms or of applicable law.
17. Changes to the Service and to these Terms
We may modify the Service and these Terms. For material changes to these Terms, we will give at least 30 days' notice by email or in-app before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
18. Export controls and sanctions
You represent that you are not located in, or ordinarily resident in, a country or territory subject to comprehensive trade sanctions, and that you are not listed on any applicable restricted-party or sanctions list. You agree not to use the Service in violation of applicable export-control or sanctions laws.
19. Governing law and disputes
These Terms are governed by the laws of France, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the competent courts of France, unless mandatory consumer law grants you the right to bring proceedings in your place of residence.
20. Miscellaneous
- These Terms, together with the Privacy Policy and any Data Processing Agreement, are the entire agreement between you and FeatBudy.
- If any provision is held unenforceable, the remaining provisions stay in effect.
- You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
- Our failure to enforce a right is not a waiver of it.
- We are not liable for delays or failures caused by events beyond our reasonable control (force majeure).
